La concepción de lo indígena es una construcción sociojurídica que se elaboró fuera del entorno cultural en que se desarrollan las comunidades indígenas, máxime cuando se trató de la jurisdiccionalidad de los sistemas normativos externos; por lo tanto, los diversos grupos indígenas de México han sido, desde su concepción teórica, vulnerables ante los sistemas de pensamiento hegemónico del sistema jurídico mexicano actual, y con ello sufren la violación directa de acudir al Derecho; un Derecho que no responde a su cosmovisión, a su campo axiológico, ni a su realidad social.

The conception of the indigenous matter is a sociojuridic construction that was developed outside the cultural environment in which indigenous communities exist, especially when dealing with the jurisdictionality of external regulatory systems; therefore, the indigenous groups of Mexico have been, from their theoretical conception, vulnerable to the systems of hegemonic thought of the current mexican legal system, and with this they suffer the direct violation of assisting before the Law; a Law that does not respond to its worldview, its axiological fields, or its social reality.
