La cultura jurídica en América Prehispánica y en la Europa Medieval: el ius commune y la monarquía hispánica
Abstract
El objetivo de la presente investigación es analizar la cultura jurídica en los años anteriores a la llegada de los españoles, específicamente, en el área de Mesoamericana y, concretamente, la cultura jurídica mexica, por ser esta civilización la que enfrentó la conquista. Asimismo, determinar las características de la cultura jurídica en la Alta y Baja Edad Media; los orígenes del derecho canónico como primer sistema jurídico en Occidente; así como las posibilidades del Ius Commune, como conjunto de disposiciones que constituyen la base fundamental del derecho en Europa, pero sobre todo de la monarquía y de la cultura jurídica hispana. The objective of the present investigation is to analyze the legal culture in the years prior to the arrival of the Spaniards, specifically, in the Mesoamerican area and, specifically, the Mexica legal culture, because it was this civilization that faced the conquest. Also, determine the characteristics of the legal culture in the High and Low Middle Ages; the origins of canon law as the first legal system in the West; as well as the possibilities of the Ius Commune, as a set of dispositions that constitute the fundamental basis of law in Europe, but especially of the Spanish monarchy and legal culture.
