¿Qué es y para qué sirve el derecho?

Abstract

Contestar a las preguntas: ¿De dónde surge?, ¿Qué es? y ¿Para qué sirve el Derecho? Implica a su vez, el poder responder las cuatro causas aristotélicas: eficiente, material, formal y final del objeto de estudio de nuestra disciplina. Se requiere partir del hecho, tomar en cuenta los valores y construir la norma jurídica adecuada, para resolver tanto los problemas sociales como salvaguardar las aspiraciones individuales y los ideales que como meta a lograr se fije una colectividad. Con el análisis de algunos juristas, se aprecian las aspiraciones, las ideas y los propósitos que permiten la construcción del Derecho, así como los tipos jurídicos, y la individualización de la norma. / To answer the follow questions: From where does, What is it? and What is the purpose the law? Turn implies, the answer to the four Aristotelian causes: efficient, material, formal and final object of study of our discipline. We need to start from the fact, taking account of the values and build the proper legal rule, to solve social problems such as safeguarding individual aspirations and ideals that goal was set out to achieving a collective. With the analysis of some jurists, we appreciate the aspirations, ideas and purposes that allow the construction of law and legal types, and individualization of the rule.
