La reforma que eleva a rango constitucional al Medio Ambiente como bien jurídico tutelado ha sido un paso importante para su protección; sin embargo, requiere de la reestructuración integral del marco jurídico incluyendo políticas públicas ambientales, cooperación interinstitucional y el impulso de medidas preventivas así como sancionadoras para la reparación de los daños. En este estudio analizaremos la pertinencia de reforma de la Ley Federal de Responsabilidad Ambiental por considerar que no toma en cuenta las necesidades urgentes de atención hacia los daños ambientales y sobre todo de imputación de responsabilidad a los perpetradores. / The constitutional reform which raises the protection of the environment as a legally protected asset, has been an important step for its guardianship; however, it requires a comprehensive reorganization of the legal frame including environmental public policies, inter institutional cooperation, and the impulse of precautionary and punishable reforms for the reparation of damages. In this research, we’ll analyze the suitability of the reform to the Federal Law of Environmental Responsibility for not considering the urgent needs for attention towards environmental damages and, above all, the imputation of responsibility to offenders.
