El presente artículo aborda el estudio del derecho humano de acceso a la justicia en materia de pensiones, su fundamento constitucional en México, así como su fundamento en la Convención Americana de Derechos Humanos Pacto de San José Costa Rica, de igual forma se analiza como debe ser entendido este derecho, y se aportan y analizan datos estadísticos de cuantos procesos se encuentran en trámite ante las Juntas Especiales de la Federal de Conciliación y Arbitraje y Tribunales del Poder Judicial de la Federación en donde se reclaman derechos pensionarios, se conocen el número de amparos promovidos en materia de pensiones en contra del Instituto Mexicano del Seguro Social. / This article deals with the study of the human right of access to justice in the matter of pensions, its constitutional foundation in Mexico, as well as its foundation in the American Convention of Human Rights Pact of San José of Costa Rica, in the same way it is analyzed as it should be be understood this right, and statistical data are contributed and analyzed of how many processes are in process before the Special Meetings of the Federal Conciliation and Arbitration and Tribunals of the Federal Judicial Power where pension rights are claimed, the number of amparos promoted in subject of pensions against the Mexican Institute of Social Security.
