Introducción a la responsabilidad patrimonial del Estado mexicano

Abstract

La doctrina constitucional reconoce a la responsabilidad patrimonial como una de las características del Estado de Derecho, pero en México, pese a su importancia evidente, no estaba regulada. Por ello, resulta relevante que apenas en el año 2004 haya entrado en vigor la reforma constitucional que la introdujo a nuestro sistema jurídico y que permite a los ciudadanos reclamar la reparación de los daños que sufran por la actuación administrativa irregular, de acuerdo a la ley (que entró en vigor en 2005) que regula el procedimiento que debe seguirse para obtener la indemnización correspondiente, mismo que es analizado en el artículo que se presenta. / The constitutional doctrine recognizes the patrimonial responsibility like one of the characteristics of the State of Right, but in Mexico, in spite of its evident importance, it was not regulated. For that reason, it is excellent that hardly in 2004 has taken effect the constitutional reform that introduced it to our legal system and that allows the citizens to demand the repair of the damages that suffer by the irregular administrative performance, according to the law (that took effect in 2005) that regulates the procedure which it must be followed to obtain the corresponding indemnification, same that is analyzed in the article that appears.
