dc.description.abstractBajo el título anterior partimos para realizar diversos comentarios en torno a la Justicia Constitucional Transnacional y a la libertad de asociación con base en la sentencia del Tribunal Europeo de Derechos Humanos No. 496/2001, de 31 de julio: El Partido Refah Partisi (RP Partido de la Prosperidad) y otros contra Turquía. Dicho documento versa sobre la disolución del Partido de la prosperidad ya que después de seguir el procedimiento establecido en la Constitución Turca, el Tribunal Constitucional Turco, disolvió al Refah Partisi; al Presidente así como a los dirigentes del partido, los destituyó como diputados y les prohibió por 5 años ser fundadores, socios, dirigentes o comisarios de otros partidos políticos, restringiendo así su derecho a la libertad de asociación, además de la confiscación de todos los bienes del partido de la prosperidad. El Tribunal Europeo de Derechos Humanos (en adelante, ETD) en su sentencia declaró que no existió violación alguna del artículo 11 del Convenio Europeo de Derechos Humanos (en adelante, CEDH) por parte de Turquía. Así, antes de llegar a la exposición de la sentencia y de los datos relevantes de la misma, consideramos oportuno realizar un breve análisis matizando conceptos tales como el derecho internacional de los derechos humanos, el derecho de asociación, las características del CEDH, todo ello relacionándolo con el caso de Refah Partisi, analizando finalmente la sentencia del Tribunal aportando nuestras conclusiones en torno a los mecanismos de interacción de la justicia constitucional nacional ordinaria y la justicia constitucional transnacional operada por el Alto Tribunal de Estrasburgo. / Under the previous title we started to comment Transnational Constitutional Justice and the freedom of association with base in the sentence of the European Court of Human Rights number 496/2001, of July 31: The Refah Partisi Party (RP-Party of the Prosperity) and others against Turkey. This document is about the dissolution of the Party of the prosperity since after following the procedure established in the Turkish Constitution, the Turkish Constitutional Court, dissolved the Refah Partisi and dismissed the President and leaders of the party delegated and it prohibited them by 5 years to be founders, partners, leaders or commissioners of other political parties, restricting their right of freedom of association, and confiscate all properties of the Party of the prosperity. The European Court of Human Rights (ETD) in his sentence declared that Turkey was not transgressed the article 11 of the European Agreement of Human Rights (CEDH). Before explain the sentence and the important data of it, we considered opportune to do a brief analysis clarifying concepts such as the international law of the human rights, the right of association, the characteristics of the CEDH, all related to the case of Refah Partisi, analyzing finally the sentence of the Court and giving our conclusions around the mechanisms of interaction of ordinary national constitutional justice and transnational constitutional justice applied by the High Court of Strasbourg.es_MX
