This “Criminal Law of the Enemy” (or Criminal Law for the Enemy), recently suggested by Professor Günter Jakobs, has generated a defeaning reaction in the international criminal law. But that reaction hasn't had the expected effect; it means, the alarm screams of the juridical comunity have sunk in a sort of unfear characterizations towards the character of the author more than in a real option of changing towards an unpredictable and expanding Criminal Law. That's why, this article pretends to be, in some way, a severe opposition to that theory, for being uncongenial with the Democratic State, and, at the same time, the expression that “Criminal Law of the Enemy” does exist; althout it is not personified in the author, but in the legislation distinguished for an excesive punishment and the reduction of individual guaranties, accepted y proposed from different parts of society.es_MX
