¿Cuándo surgió el sistema jurídico mexicano? un modelo para el estudio sistémico de la evolución del derecho

Abstract

El objeto de este trabajo se dirige a analizar el momento en que surgió el derecho y el Estado mexicanos, ya que dentro de la Historia del Derecho y de la teoría del Estado y del Derecho Constitucional no existe homogeneidad sobre este tópico. Para tal efecto, primero se efectúa una metodología analítico-conceptual sobre el significado de sistema, para posteriormente, abordar la connotación de sistema jurídico; de igual forma, se analiza la relación entre la norma y el de sistema jurídico, para entender la diferencia entre validez y eficacia. Posteriormente, mediante un modelo de análisis sistémico, vamos a estudiar la historia del derecho durante la fase de emancipación de nuestro país, para conocer cómo se sustituye un sistema jurídico por otro, y específicamente, para dar respuesta a nuestros planteamientos: ¿Cuándo y mediante qué documento se origina el sistema jurídico mexicano? Y ¿Cuál es el primero documento constitucional en México?

The purpose of this work is aimed at analyzing the moment in which Mexican law and the State arose, since within the History of Law and the theory of the State and Constitutional Law there is no homogeneity on this topic. To this end, an analytical-conceptual methodology is first carried out on the meaning of system, and later, the connotation of the legal system is addressed; likewise, the relationship between the norm and the legal system is analyzed to understand the difference between validity and efficacy. Subsequently, through a systemic analysis model, we will study the history of law during the emancipation phase of our country, to learn how one legal system is replaced by another, and specifically, to respond to our approaches: when and through what document originates from the Mexican legal system? And what is the first constitutional document in Mexico?
