Los esponsales en la antigua Roma y sus reminiscencias en la legislación mexicana actual

Abstract

El presente trabajo, está basado en el libro vigésimo tercero, título primero del Digesto (D. 23, 1), el cual se titula De sponsalibus, en el expondré lato sensu cómo se constituían los esponsales en la antigüedad romana, cuáles eran los requisitos y los impedimentos para que estos se llevaran a cabo; asimismo, analizaré las reminiscencias y los puntos de intersección entre los esponsales según el Derecho Romano y los que se encuentran en los Códigos Civiles de siete de las 32 Entidades Federativas que conforman los Estados Unidos Mexicanos.

In the present work, based on the twenty-third book, first title of the Digest (D. 23, 1), which is entitled De sponsalibus, I will expose lato sensu how the engagement was constituted in Roman antiquity, what were the requirements and the impediments for these to be carried out; also, I will analyze the reminiscences and points of intersection between the engagement according to the Roman Law and those found in the Civil Codes of seven of the thirty-two Federative Entities of the United Mexican States.
