Algunas consideraciones sobre la declaratoria general de inconstitucionalidad

Abstract

El presente extenso constituye una de las primeras aproximaciones a la Declaratoria General de Inconstitucionalidad y contiene una propuesta de definición en la que se analiza su naturaleza jurídica mediante el estudio de sus elementos característicos y de sus principios. También aborda el tipo de normas que pueden ser invalidadas por esta nueva figura jurídica y los actos procesales y procedimentales que son necesarios para llevarla a cabo. Finalmente, se expresa una proyección sobre los posibles efectos que el Pleno de la Suprema Corte de Justicia de la Nación debe dar a ese nuevo mecanismo de control constitucional. / This article constitutes one of the first approximations to the General Declaration of Unconstitutionality and contains an offer of definition in which his juridical nature is analyzed by the study of his characteristic elements and of his principles. Also it approaches the type of laws that can be invalidated by this one new juridical figure and the procedural acts that are necessary to carry out her. Finally, it presents a projection about the possible effects that the Plenary session of the Supreme Court of Justice of the Nation must give to this new mechanism of constitutional control.
