Transexualismo. Dignidad humana y no discriminación: trascendencia del criterio emitido por la Suprema Corte de Justicia de la Nación (Opinión)
Abstract
La “reasignación sexual” que decida una persona transexual, que puede comprender o no una cirugía para ese fi n, con el objeto de adecuar su estado psicosocial a su físico y, de ahí, vivir en el sexo con el que se identifica plenamente, es un aspecto que, sin lugar a duda, constituye una decisión que forma parte del libre desarrollo de la personalidad, en tanto es una expresión de la individualidad de la persona, respecto de su percepción sexual ante sí mismo, lo que influye decisivamente en su proyecto de vida. La preeminencia del sexo psicosocial da real concreción a los derechos fundamentales de una persona transexual, primordialmente su dignidad humana y no discriminación, que en este caso encuentran su pleno respeto a partir del que se dé a otros derechos, como son el libre desarrollo de la personalidad, la autonomía personal, el derecho a la salud, a la intimidad y a la vida privada. El cambio registral y la consiguiente expedición de una nueva acta, no perjudica derechos de terceros o afecta a la sociedad, en tanto no se trata de que se borre la historia de una persona y, además, existen mecanismos legales que permiten la protección de aquellos, máxime que tal cambio registral no implica la mala fe del individuo, sino, por el contrario, la real concreción de la adecuación de su realidad personal a su realidad jurídica. / The “sexual reassignment” decided by a transsexual, that can include or not a surgery for that aim, with the intention of adapting its psychosocial state to its physicist and, of that, to live in the sex with whom he is identified totally, is an aspect that, without doubt, constitutes a decision that comprises of the free development of the personality, in as much is an expression of the individuality of the person, with respect to its sexual perception before itself, which influences decisively in the project of life. The pre-eminence of psycho-social sex occurs to real concretion to the fundamental rights of a transsexual, prior its human dignity and nondiscrimination, that in this case finds their total respect from the one that is given to other rights, as the free development of the personality, personal autonomy, health rights, the privacy and the private life. The registry change and the consequent expedition of a new act, do not harm rights of third parties or affect the society, in the instance that it does not erase the history of a person, in addition, it exist legal mechanisms that allow the protection of those, especially that such registry change does not imply the bad faith of the individual, on the other way, the real concretion of the adjustment of his personal reality to his legal reality.
