El estado de cosas inconstitucionales en Colombia y su posible aplicación en México

Abstract

El Estado de Cosas Inconstitucionales, es un conjunto de hechos, acciones u omisiones que dan como resultado una violación masiva de los derechos fundamentales. El derecho social en México no ha sido plenamente eficaz, es por ello que es necesario mejorar en mucho los mecanismos procesales para la defensa de la Constitución. El caso colombiano es excepcional, en el cual, gracias a una serie de factores resultó una Constitución sustantiva, con gran contenido en materia de protección y, al mismo tiempo, mecanismos de acción y de justicia constitucional efectivas que ayudan a la consecución de estos derechos sociales. La Corte Constitucional de Colombia sólo tiene un límite en su competencia y es el de realizar todo lo que esté a su alcance para lograr que su Constitución conserve su integridad y supremacía. / The State of Things Unconstitutional, is a collection of facts, actions or omissions which results in a massive violation of fundamental rights. Social right in Mexico has not been fully effective, which is why it is necessary to improve a lot in defining the procedure for defending the Constitution. The Colombian case is exceptional which, thanks to a number of factors resulted in a substantive Constitution, with great content in terms of protection and at the same time, fulfilling actions and Constitutional Justice effective in order to help establish these rights. Colombia’s Constitutional Court only has a limit on its jurisdiction and is to make everything in their power to ensure that the Constitution retains its integrity and supremacy.
