Se han realizado diversos estudios de medición de los sistemas jurisdiccionales, sin embargo, sólo pocos de ellos se basan en los indicadores objetivos. Por tal razón, a solicitud del Gobierno de Chiapas, un grupo de investigadores independientes desarrolló una metodología y realizó un estudio que permita medir la eficiencia y calidad del sistema de justicia para menores. Dicho estudio analiza un número de elementos para determinar las deficiencias y mejores prácticas en la implementación de la ley, incluyendo las percepciones de los abogados litigantes, víctimas del delito y los menores acusados. No obstante, lo anterior, la piedra angular del estudio es el análisis de las resoluciones jurisdiccionales lo que representa un método único que permita identificar la brecha entre la ley en acción y la ley en los libros. Es importante subrayar que el objetivo principal del presente estudio es diseñar los mecanismos para mejorar el sistema de justicia para menores a través de la implementación de mejores prácticas internacionales, así como el fortalecimiento de capacidades institucionales. /
There are a lot of studies on benchmarking of judiciary system, however few of them are based on objective indicators. Therefore, on the request of the Government of Chiapas, a group of independent researches developed a methodology and carried out a study that permits to measure the efficiency and quality of the juvenile justice system. This study considers numerous elements to determine both deficiencies and best practices of law implementation, including perceptions of lawyers, victims and accused minors. Notwithstanding the above, the cornerstone of the study is the analysis of judicial rulings, which is a unique method to identify if there is breach between law in action and law in the books. It is worth mentioning that the main objective of the study is to design mechanisms aimed at improving the juvenile justice system though implementation of best international practices and enhancing it institutional capacity.
