dc.description.abstractLa búsqueda de una definición general absoluta para caracterizar la función de los jueces, válida para todos los casos en todos los países y en todas las épocas, es imposible. Debemos conformarnos con aproximaciones generales. El papel de los jueces en una sociedad determinada no puede ni debe resolverse por lo que hace cuatro siglos hayan dicho Coke o Bacon en Inglaterra a favor de sus respectivos intereses políticos, ni por lo que hace 250 años haya sostenido Montesquieu con el propósito de disminuir el despotismo de los reyes, ni por lo que dijo John Marshall hace 200 años en la resolución que dictó en el caso Marbury vs. Madison con el propósito de acrecentar su poder político. La única forma adecuada de precisar cuál debe ser el papel de los jueces en una determinada sociedad, es plantear el tema de una manera totalmente abierta, sin dogmas y sin prejuicios, viendo únicamente lo que es conveniente para la mayoría de la población y para las minorías disidentes en diferentes circunstancias, a fin de determinar cuáles son los poderes que deben prestárseles a los jueces, sus límites y las medidas indispensables para evitar su abuso. / The search of a general and absoulte definition to characterize what judges do, valid for all cases in every country and every time, is impossible.We should conform ourselves with general approaches. The paper of the judges in a certain society cannot nor must be solved based on what four centuries ago Coke or Bacon have said en England in favor of its respective political interests, nor based on what 250 years Montesquieu had sustained with the purpose to diminish the despotism of the kings, nor based on what John Marshall said 200 years ago in the resolution that he dictated in the Marbury vs. Madison case in order to increase his political power. The only form —and the accurate one— to establish which has to be the paper of the judges in certain society, is to raise the subject ina a totally open way, without dogmas and damages, taking care of what is convenient to most of the population and for dissident minorities in different circumstances, in order to determine which are the faculties of judges, their limits and the indispensable measures to avoid abuse.es_MX
