Los derechos humanos y la necesidad de un control preventivo a la constitución federal
Abstract
El 3 de septiembre de 2013, el Pleno de la Suprema Corte de Justicia de la Nación, por mayoría de 10 votos, resolvió, entre otras cosas, que cuando en la Constitución Política de los Estados Unidos Mexicanos exista una restricción expresa a los Derechos Humanos (DDHH), ésta debe prevalecer sobre cualquier otra regulación, aun cuando las demás, bajo el principio pro persona y sean más benéficas o menos lesivas a las y los mexicanos. Ante ello, es necesario determinar si en el sistema jurídico mexicano procede algún recurso, juicio o medio de defensa en contra de lo que la Constitución pueda consagrar y, de no existir, si puede configurarse alguno sin contravenir la supremacía constitucional. On 3rd September 2013, the plenary of the Supreme Cort of Justice, by a majority of 10 votes, resolved, among other things, that when there is an express restriction on human rights in the Political Constitution of the United Stated of Mexico, it must prevail over any other regulation, even if others, under de pro-person principle, are more beneficial or less harmful to Mexicans. In view of this, it is necessary to determine whether any appeal, trial or means of defense are involved in the Mexican legal system, contrary to what the Constitution may enshrine and, if it does not exist, if any can be configured without contravening constitutional supremacy.
